Artist Marketplace Policy & Seller Terms

This policy explains how independent artists sell original artwork through Artmines.ie. It is intended to be read by artists and customers together with our general Terms & Conditions, Privacy Policy, Shipping & Delivery Policy and Refunds & Returns Policy.
1. Marketplace role
Artmines provides the online gallery, checkout, order administration and customer communication for approved artists. Unless otherwise stated on a listing, the artist is the creator and supplier of the artwork and Artmines acts as the marketplace/gallery intermediary administering the transaction.
2. Commission
Artmines retains 20% of the artwork selling price for each completed marketplace sale. The artist is credited with exactly 80% of the artwork selling price. Stripe payment-processing charges are paid from Artmines' 20% share and do not reduce the artist's agreed 80% proceeds. Shipping charges, taxes, refunds, chargebacks or other transaction adjustments may be treated separately where applicable.
3. Artist approval
Artist accounts and individual artworks must be approved by Artmines before they appear publicly. Artmines may reject, suspend or remove listings that are incomplete, unlawful, misleading, poor quality, infringing, unsafe or inconsistent with the gallery.
4. Artist responsibilities
Artists must provide accurate titles, descriptions, dimensions, medium, condition, framing details, images and prices. Artists confirm they created the artwork or have the full legal right to sell it, and that listing images and descriptions do not infringe another person's copyright, trademark or other rights.
5. Original one-of-one works
Unless clearly described otherwise, original artwork is treated as a one-of-one item. Once ordered it may be reserved immediately. After payment is confirmed it is marked sold and must not be sold elsewhere.
6. Pricing and changes
Artists can suggest and edit their own prices through the Artist Portal. Material edits to approved artwork may return the listing to review before it is republished.
7. Payment and artist payout
The customer pays Artmines through secure checkout. Artmines records the artist's 80% proceeds and 20% commission when payment is confirmed. Artist proceeds are held until delivery or collection is confirmed and Artmines approves release. Payouts are made through the artist's Stripe connected account after Stripe identity and payout verification is complete. Artmines does not store the artist's bank-account details. Immediate cancellation, refund, fraud or dispute issues may delay or reverse a payout where permitted by law and these terms.
8. Shipping, packing and delivery
The artist is responsible for safe packaging where the artwork ships directly from the artist unless Artmines agrees otherwise. Any stated dispatch deadline must be followed. Tracking information should be supplied where available. Damage, non-delivery or materially inaccurate descriptions may result in a refund or claim against the transaction.
9. Returns and consumer rights
Customer statutory rights under Irish and EU law remain unaffected. Whether a cooling-off right applies can depend on the nature of the artwork and transaction. Faulty, damaged, misdescribed or non-conforming goods remain subject to applicable consumer remedies.
10. Copyright
The artist retains copyright in the artwork unless separately agreed. The artist grants Artmines a non-exclusive licence to display, resize and use submitted artwork images and profile information for operating and marketing the gallery and the artist's listings.
11. Taxes and reporting
Artists are responsible for their own income tax, VAT registration and other tax obligations unless the law places a specific obligation on Artmines. Artmines may collect and retain seller identity, transaction and payout information where required for accounting, anti-fraud, DAC7 or other legal reporting obligations.
12. Refunds, chargebacks and disputes
Artmines handles customer payment refunds and card disputes for marketplace transactions. If a transaction is refunded, reversed or charged back, related artist proceeds may be withheld or, if already transferred, recovered or reversed where legally permitted. Artmines will use available order and delivery information to resolve legitimate disputes.
13. Payout records
The Artist Portal shows sale price, Artmines commission, artist proceeds and payout status. A payout marked “paid” records that Artmines has processed the artist payment; bank processing time may still apply.
